“Efforts in California to pass a comprehensive net neutrality law hit a snag on Tuesday after a key committee, which is chaired by a Democrat whose coffers are flush with telecom industry cash, suddenly threw a wrench in the works.
Two California state lawmakers struck a deal on Monday to combine two net neutrality bills introduced separately this year—SB 822 and SB 460—both of which have cleared the state’s Senate. Working in tandem, the bills would ensure that Californians have the same level of protection against net neutrality violators as granted under the 2015 Open Internet Order, which established the federal net neutrality rules officially repeal by the Trump administration one week ago.
Instead of accepting amendments to combine SB 822 and SB 460, however, Assemblyman Miguel Santiago, chair of the Communications and Conveyance Committee, is likely to propose his own, according to a source with direct knowledge of the negotiation. Santiago, the source said, intends to substantially diminish the end legislation’s effectiveness, leaving enormous loopholes for internet service providers (ISPs) such as AT&T and Comcast to exploit.
The plan to unify the two bills was announced Monday by State Senators Scott Wiener and Kevin de León, the authors of SB 822 and SB 460, respectively. The decision was widely praised by, among others, California Attorney General Xavier Becerra and Alexis Ohanian, the co-founder of Reddit and Initialized Capital. Federal lawmakers, too, have weighed in on the legislation, believing that the California bill will set the bar for any other state-level net neutrality laws to come, as well as boost efforts to reject the new Federal Communication Commission’s (FCC) rules in the House of Representatives.
The passage of a toothless net neutrality bill in the liberal haven that is California’s legislature would serve as a humiliating moment for the Democratic Party.
“We will not settle for the weak bills pushed by Republicans that eliminate crucial consumer protections and are net neutrality in name only,” House Minority Leader Nancy Pelosi wrote Monday in a letter to Santiago. Senator Edward Markey, a member of the Commerce, Science and Transportation Committee, tweeted Tuesday that major internet providers were working hard to weaken any future California law, adding: “everyone is watching.”
The telecom industry is, in fact, working hard to disrupt the passage of California’s net neutrality legislation—in particular, SB 822, a bill which mirrors not only the handful of pages that make up the underlying rules of the 2015 Open Internet Order, but the 300-pages worth of explanations contained in the order itself.
While the rules alone prohibit ISPs from blocking or throttling internet traffic, or creating so-called “fast” and “slow lanes,” the full order explains at length the reasons the rules exist and how they should be applied, codifying a number of protections that aren’t explicitly laid out in the rules’ simple text.
The rules do not, for example, address the unreasonable fees ISPs may impose on application and content providers in order to reach end users—i.e., access fees—which the order defines as a form of blocking. Nor do they address ISPs congesting interconnection points to force payments from providers managing traffic along the internet’s “backbone.” Nor do the rules address “zero rating,” a practice whereby ISPs get to pick and choose which websites and services consumers can use without impacting their data limits.
The bill authored by de León, SB 460, did not include these additional protections; however, it would if it is successfully combined with SB 822. Instead, if amended to be conjoined with SB 822, SB 460 would focus on ensuring that net neutrality violators are prohibited from entering into public contracts, a practice which is being adopted via executive power in handful of other states, including New York.
Senate lawmakers had expected Santiago’s committee to release a report Tuesday morning endorsing the amendments to combine the two bills. But that didn’t happen. Now the authors are convinced that Santiago is likely to propose amendments of his own which neglect the 2015 order’s broader explanations—leaving ISPs loopholes through which they can charge businesses and content providers exorbitant fees.
The telecom industry, and AT&T in particular, have been applying enormous pressure to California lawmakers in an effort to defeat SB 822. One of the industry’s prime targets remains Santiago, to whom major ISPs have contributed more than $29,000 this election cycle, according to campaign finance records, including $7,800 from AT&T and its affiliates.
AT&T has papered the California legislature with flyers denouncing SB 822 as an “unwarranted attack on an industry that invests billions in infrastructure in California,” though the provisions it seeks cut are largely designed merely to prohibit “unreasonable fees.” An “advocacy” group supported by AT&T, known as CALInnovates, has also targeted California residents with social media ads bashing SB 822. Many of the ads include the online handles of Democrats on the state’s Communications and Conveyance Committee.
Santiago’s office did not respond to multiple requests for comment.
In a press release, digital-rights group Demand Progress called on Santiago to reject the whispers of his supposed plan to kill the Wiener and de León amendments. “Assemblymember Santiago must put an end to rumors that he is acting on behalf of AT&T and other giant ISPs by attempting to sink the strongest net neutrality protections to be considered by a state, or he will quickly become known as California’s Chairman Pai,” the group’s communications director, Mark Stanley, said in a statement.
Despite Santiago’s expected rejection of a unified bill, the two authors will have the opportunity to reintroduce the amendments before Santiago’s committee Wednesday morning. The Communications and Conveyance Committee hearing is slated for at 9:30am PST.

Having had enough discussions with Trumpers who were adversely affected by Trump policies (some lost everything including family members who were deported for misdemeanors committed 35 years ago) I came to the realization that they know exactly what they bargained for and have no problem in suffering the consequences. I might be in the minority, but I love when Jimmy and Michael are on the main show at the same time, because no one else properly challenges Michael! People get lulled in by his voice, whereas Jimmy can cut right through that.
The problem with building a 3rd party is money, and generational advantage. I think Sanders believes that there needs to be a fight for the Democratic party before the fight for the country can win. In California, 3rd party candidates could probably win seats in the jungle primary. Elsewhere it would be difficult. I don’t think the demographics favors a 3rd party without money. It’s a fight either way.

Could be a refusal to devote the money required to have enough employees or better third party support. I dont know why. I just know they have always struggled with IT. As a programmer and tech enthusiast, I have always wondered if I watched In-Studio, if at the end of the day I would run in horror at their setup or employees.

I read a story that one county in Alabma had the sheriff’s department get caught throwing blacks in jail on trumped-up charges and planted evidence. They had put over 10,000 innocent blacks,, and this was in ONE COUNTY! WWII never ended and the police departments are Gestapo units. The system is not going to be cleaned up by one election cycle.
I disagree with Jimmy about Bernie. I think there is a chance to transform the Democratic party. Also, I would support almost anything that gives Bernie a better chance of winning. My biggest hope would be Bernie runs in 2020, if he doesn’t win the primary then he run as a third party.

Totally agree that there’s a chance to reform the Democratic party, even if it is painfully slow. WE ARE MAKING PROGRESS. After November, we will have maybe 10 justice democrats in congress. That’s huge! Just by using their media coverage to talk about money in politics, they’ll pressure other Dems into rejecting corporate PAC money. Gillibrand, Booker, etc. taking a similar pledge (whether or not it’s pure political calculation) is a GREAT thing.
Starting a new party from scratch right now would play out like this in 2020:

Dem candidate 40% of the vote
Our Revolution 19%
Libertarian/Green like 1%
Electoral college would probably be won by Trump again.

There is no more entitled generation than Baby Boomers. I’m tired of hearing about the 60’s and how much they did. They’ve been in charge for 25 years and look where we are. They did change the world for 10 years, but then they changed it back and then some once they got theirs. They act like other generations don’t try hard enough and that’s why things are tough for us. They had far more advantages, especially economically, and they shut the door on the rest of us for selfish and greedy reason.

I’m a senior who agrees with your agenda in most scenarios. However, you show predictable youthful intolerance antithetical to the spirit of free inquiry and respect absent from all(and I do mean all) sides. And I have Edward as my middle name. And I live in Switzerland and followed the financing of the pipeline from Swiss banks. And the direct subsidies of the Swiss (and other) Chemical industries for both the Fracking industry as well as the Tar Sands. And living in Europe, thanks for the Fracked oil and Bitumin. I am also an advocate of electric vehicles, and Europe will never change. Mark Blythe had a great lecture about the ties of the Euro to the German Auto industry. And it is all financed by the Swiss Central Bank. In the age of Trump, everybody is letting their masks down. Recently the Swiss government decided to not ban Glyphosate, to not ban plastic bags in stores, to not promote EV infrastructure, and to sell weapons to more countries as long as they have moderate rebels. And a Swiss Cement company was caught dealing with ISIS and helped build those tunnels that they found in Syria. When I saw them, I said that they were Swiss made. I try to be an Aggressive Progressive here and I am looked at as crazy. But everyone is in the system. Every foreign worker hates the system, but they are paid OK and keep their mouths shut and go along with the annual mass sheep migration in their gas guzzling SUV.

We’re old enough now to have the life and work experience to get our shit together in a focused effort. I think over the next 5-10 years, things are going to look so different. The wave is coming, and we’re finally able to rock the boat. When you get knocked out of the nest, it takes a bit to learn how to fly. Instinct is going to take over and we’re gonna be soaring over these old and dying birds soon. A strong theme of our generation has been to be better than our parents before us. I can’t tell you how strong Republican my parents are in a place like Arkansas, but I know they’re good people, but they’re brainwashed by fox news and the like because of the glorification of the good ole days. When we talk about politics, we disagree, but then we always agree on the humanitarian issues. Then we’re back and forth on how their views on certain political issues don’t correlate with those humanitarian values. I’m not alone in this either. As i’m exposed to people of all backgrounds and counsel them, that same trend shows up more and more. We’re coming, and soon. The next 5-10 years are going to be crazy and heated, but we’re taking over and there’s nothing they can do to stop us. All the money in the world can’t stop us, it’s helping them cling on, but time and our generation are not on their side. And it’s already happening, Barack Obama and Bernie’s followings are evidence of that. Barack turned out to be a fake and Clinton was a fake too, just more obvious. Fool me once, shame on you, we weren’t going to get fooled again. Choosing Clinton as the candidate (even though we were supposed to make that decision) was the biggest mistake the Democrats could do to show their real colors. Now everyone is in on their game, and not just those of us who pay attention to politics. Let’s see how the rest of the primaries and elections turn out this year. Generation Jones here, and I don’t have a romantic view of WWII. In fact, WWII never ended. We put a few people on trial, but the real nuts and bolts workers were bought over and put into the military-industrial complex or the CIA, or went into our Gestapo. You might have seen a new TV show about this Gestapo Force, “Chicago Police”. I have seen victims of Atomic Bomb blasts. They are called Utahans. I think that the first country that we invaded after the war ended was either Greece or Italy in 1946, since they wanted to elect non-corporate politicians. Do you remember going under your school desk and covering your head? Did you feel safe? I remember the day Kennedy was shot. My Grandfather worked at the Dallas newspaper and they were putting out wanted posters on JFK. I have no memories of my grandfather, which is good since he was apparently a racist violent asshole child beater. I remember the taste in my mouth when the report came out on the assasination.
But I am totally not a conspiracy theorist when it comes to the big one. It was the box cutters and the planes going into the two big towers, and I think it was a landing gear that came off and caused damage to Building 7. Am I right? What a way to start the new Wars.
I am frustrated by the lack of coherent progressive electoral strategy. If we want a real progressive movement, the only two alternatives are to either take over the Democratic Party from within, or to form another party. It has to be one or the other, not both. I am just as excited as anyone about AOC’s election result, but that’s because I feel that until you get money out of politics, no party other than the two party cartel will have any kind of chance to make a permanent impact. Thus I believe in the insurgency strategy, which is admittedly a slow and painful process. I love how Jimmy keeps the hammer down on the corrupt Democrats and exposes them as the non-progressive frauds that they are. But unless you are willing to fix them from within (as AOC is trying to do), then griping about them is no more productive than griping about the Republicans. I don’t give a shit about a “divided Democratic Party”, but I do have great concern about divided progressives, which has been a thing from time immemorial unfortunately. Progressives need to unite behind a coherent vision with the goal of electoral success, whatever that vision may be.
I believe in fighting on many fronts at once, and not putting all one’s eggs in one basket. I am DemEnter and working hard within the party to make change happen — have seen enormous progress at the most local level, where our county’s Democratic Central Committee has slowly but surely been moving leftward during the two years I’ve served on it.
It is really about education — their relative conservatism was based on the information/indoctrination they received from MSM. Now they are seeing all the events of 2016 with a new lens of awareness, and they are realizing how badly the Dems messed up, and how the current Dem establishment continues to want to mess up. I shared You Tube clips of Nomiki at the Unity Reform Conference with the DCC — it made a huge impact. We need to educate all Democrats about this crucial topic. It is too easy for people to assume that the people at the top know what what they are doing. Millenials should be reaching out to communicate with older voters who still rely upon MSM for their news. Based on my experience… it works. (I am not a millennial but I play one on our DCC.)
At the same time, I have already pledged to the Draft Bernie for Third Party movement. If the Dems try to shut him out in 2020, I am ready to jump off the sinking ship.
I see all the progressive networking going on right now as laying the foundation for EITHER a new party or a take-over of the Dems. We can work on both at once.

Only slightly joking, good for you. I am an Ex-Pat and can’t get involved in any politics. And I don’t like the Americans living in Switzerland that have close ties to America since they are in the Corporate machine. But I look at the futility of any talk about political reform if you don’t take care of electoral reform. Gordon Dimmack had a great post on the Venezuela electoral process, which is the best in the world. I highly recommend it, and his channel is worth the view.
TYT is changing. The main reason I subscribe is for Jimmy. The changes to this network are subtly turning it into your typical commercial mainstream media outlet (this last term is what TYT seems to be describing itself now…).

I could not agree more with Imission. Just post AP as soon as it is finished taping. I don’t care about having to fast forward through breaks and censorship should not be an issue since this is a members only show. If TYT want to refine the video and upload it again without the breaks then great. But what fucking good is news that is 2 days old?
The only reasons that I have a TYT subscription is for AP and the live election coverage. If TYT keeps this schedule for AP then I am going to cancel my TYT membership and switch to Jimmy’s $5 service. I think I would get more content with Jimmy in it that way anyways. People that have TYT memberships want to see more Jimmy Dore. Put him on the main show more and he should on the election coverage so we don’t have to watch Michael put everyone to sleep.
